Wage & Hour

Welch Consulting was retained by counsel for a national production and retail company to analyze and testify about nationwide class wage and hour claims of failure to pay overtime. Our economist compiled data from different payroll and personnel file systems in order to accurately develop measures of overtime compensation under applicable California and federal laws.

Welch Consulting was retained by a large national home improvement retailer to study time clock and payroll data to ascertain the degree to which overtime compensation was paid in Nevada locations and whether or not statistical evidence of an unwritten policy forbidding payment of overtime existed. Our economist reported that for non-exempt employees a large fraction of pay periods showed overtime compensation and that no statistical pattern existed.

Welch Consulting was retained by a national delivery company to analyze and testify about nationwide class action claims of interrupted breaks and off-the-clock work. Our economists integrated a large complex array of timekeeping data with delivery/pickup tracking data to quantify the extent to which breaks were interrupted. Our analysis of the data showed that interrupted breaks were relatively rare events and largely concentrated among a small number of employees.

Welch Consulting was retained by counsel representing a national telecommunications company in a California class action where claims of off-the-clock work and failure to pay overtime were made. Our economists effectively combined assorted sources of information for computer log sign-in and telephone use with data on employee schedule and actual time punch data. Working with this data our economists were able to accurately analyze the extent violations apparent in the data and estimate more precise damage calculations.

Welch Consulting was retained by attorneys representing a large national pharmaceutical company in a nationwide class action with a variety of wage and hour claims nationally as well as under California law. Our experts assisted in processing different sources of data for analysis, developing a sampling approach for purposes of obtaining a representative sample of declarations on hours worked and duties performed, and calculating exposure for damages.

Welch Consulting was retained by attorneys representing a national insurance company in a California class action where claims of misclassification, failure to pay overtime and violations of California’s meal break codes were made among claims representatives. Our economists used the time card records of employees after their jobs were reclassified to non-exempt in order to generate reliable estimates of hours worked for extrapolating to the period when the employees were classified as exempt.
