Discrimination

Welch Consulting was retained in a consulting capacity to assist a large national outdoor retailing company in answering claims made by the EEOC regarding hiring and promotion practices among protected groups. Our economists translated the data from hard copy applicant materials to an electronic database for analysis and incorporated external sources of labor market availability and interest measures in assessing whether selection outcomes corresponded with interested applicant pools.

Welch Consulting economists were retained to consult for a large national software company to audit company practices in the areas of hiring, promotions, evaluations, compensation and terminations among protected groups. Our economists developed models for each practice and a process for quickly transforming unprocessed company files into analysis ready data suitable for investigation. These audits are performed at regular intervals and the results are presented to the company and its attorneys in a clear, concise manner.

Welch Consulting was retained by a nationally recognized research laboratory to assist in an audit of an existing compensation structure for employees at all levels of employment. Our economists studied the pay practices in place to ascertain whether unexplained differentials existed between groups of similarly situated employees and estimated recommended adjustments in compensation where necessary.

Wage & Hour

Welch Consulting was retained by counsel representing a national telecommunications company in a California class action where claims of off-the-clock work and failure to pay overtime were made. Our economists effectively combined assorted sources of information for computer log sign-in and telephone use with data on employee schedule and actual time punch data. Working with this data our economists were able to accurately analyze the extent violations apparent in the data and estimate more precise damage calculations.

Welch Consulting was retained by attorneys representing a large national pharmaceutical company in a nationwide class action with a variety of wage and hour claims nationally as well as under California law. Our experts assisted in processing different sources of data for analysis, developing a sampling approach for purposes of obtaining a representative sample of declarations on hours worked and duties performed, and calculating exposure for damages.

Welch Consulting was retained by attorneys representing a national insurance company in a California class action where claims of misclassification, failure to pay overtime and violations of California’s meal break codes were made among claims representatives. Our economists used the time card records of employees after their jobs were reclassified to non-exempt in order to generate reliable estimates of hours worked for extrapolating to the period when the employees were classified as exempt.

Economic Damages

Welch Consulting was retained by attorneys for national home improvement retailer to calculate exposure relating to travel time. Plaintiffs claimed large amounts of damages due to uncompensated travel time and mileage reimbursements. Our economists used appointments data for outside sales representatives to develop measures of the actual distance traveled and estimates of associated travel time. Using the actual appointments data, Welch Consulting was able to establish an accurate estimate of how much time was actually spent traveling by plaintiffs.

Welch Consulting was retained by attorneys for a national arts and crafts retailer to estimate exposure for meal and rest break violations in its California stores. Our economists worked up a sampling approach to studying a representative sample of stores during representative parts of the year in order to estimate damages. These estimates were made under a number of different alternatives for waiver eligible shifts and grace period minutes.

Welch Consulting was retained by attorneys representing a national information management company to assist in generating estimates of exposure relating to misclassification claims. Our experts combined employment and payroll data in order to accurately estimate rates of pay for relevant groups of employees under different alternatives regarding the liability period, and the components of compensation to be included.

Audits of Employment Practices

Welch Consulting was retained by attorneys representing a large national home improvement retailer to conduct a nationwide audit of its retail operations. Our analysis and comprehensive reporting focused on hiring, assignment, compensation, promotions, training and terminations. Our economists analyzed each practice with regard to race and ethnic, gender and age based protected group status. The analysis was initiated across time and at each level of the company; from individual departments to stores, districts, regional and nationwide aggregations.

Welch Consulting economists were retained to conduct an analysis of possible compensation differences on the basis of gender among faculty members at a nationally recognized medical school. Our economists met with faculty members, utilized available data to construct compensation models under different approaches, and submitted a report of findings to the university.

Welch Consulting was retained by attorneys representing a large national retail company to analyze its compensation system. Our analysis and reporting focused on whether pay changes were in line with the company’s pay plan, identifying possible pay differentials attributable to race, ethnicity and gender and recommending adjustments if needed. Our economists analyzed compensation of hourly and salaried employees by year, grade, job, geography and by their prior job history in the company.

Statistics & Large Data Management

Welch Consulting, as part of a wide-ranging equal employment matter was asked to deploy a client vendor’s proprietary oracle database containing thousands of various tables with case relevant information. The vendor, who was unable to extract their own data in a cost effective manner to meet the deadlines imposed by the discovery and trial calendar, assured the client no one could do so in less than a year. Welch Consulting deployed the database, extracted the relevant information, and processed the data for analysis and production on time and on budget.

Welch Consulting was retained by attorneys for a national retailer in a national class action regarding classification of managers. Our economists leveraged available employment history data and generated individual level activity reports showing the extent to which managerial activities, including hires, reviews, terminations, transfers and promotions, were being conducted by tens of thousands of managers.

Welch Consulting was retained in a consulting capacity by a national retail company to analyze performance evaluations among its salaried employees. Our economists compared the performance evaluations on the basis of gender, race, ethnicity and age. The study extended to analysis of the degree of association between the demographic status of the employee and that of the reviewer and whether differences in ratings were increasing or decreasing over time.

Credit, Lending & Insurance

Welch Consulting was retained by attorneys for a major national mortgage market participant to conduct a study of whether loans to minorities and low-income homeowners were more likely to have high interest rates, as reported in the expanded Home Mortgage Disclosure Act (HMDA) data.

Welch Consulting was retained to conduct a series of analyses for Fannie Mae and Freddie Mac in a number of areas. In one study, Welch economists analyzed how HUD defines “underserved areas” in its regulation of lending to minority and low-income borrowers by Freddie Mac and Fannie Mae. In another, Welch economists used Home Mortgage Disclosure Data (HMDA) and Census data to analyze the effect of revised lending goals for underserved areas set US Department of Housing and Urban Development (HUD). Still another report, distributed to congressional staff and the financial media, assessed the relative costs and benefits of federal sponsorship of Freddie Mac.

Welch Consulting was retained to conduct several studies to assist a major insurance company in responding to a state insurance department’s regulations concerning quarterly market reports in which companies provided detailed data on vehicles and dwelling units insured by ZIP Code.
